Terms of use

These terms apply when you use Castabout on the web, iPhone or Android. The app is run by [your legal name] (“we”, “us”). By using it you agree to these terms. If you don’t agree, please don’t use the app.

Fishing information is a guide, not an authority

• Regulations. Rules, seasons, bag limits and closures in the app are summaries to help you find the official source. They can be incomplete or out of date. Always check the current rules from the relevant authority before you fish. Their links are provided with each summary. You are responsible for holding the right licence and following the rules.
• Conditions. River flows, water temperatures and condition ratings come from government gauges and our own calculations. Gauges can be late, faulty or far from where you fish. A “Prime” rating is not a safety assessment.
• Access. Access points come from public datasets. Access can change, and some land may be private. Respect landowners, closures and signs.

Your safety is your responsibility

Rivers and lakes are dangerous. Flows can rise quickly, especially below dams and during snowmelt, and rocks are slippery. Check the weather, tell someone where you’re going, wade carefully and turn back if in doubt. We’re not responsible for decisions you make on the water.

Your account

You sign in with Apple or Google, and you’re responsible for activity on your account. You can delete it at any time from Profile.

Your content

Your journal entries, catch records and photos stay yours. You give us permission to store, process and show them to you, and to back them up, only so that we can run the app for you. We don’t publish or share them. If sharing features are ever added, they’ll be opt-in. Don’t upload anything you don’t have the right to share, or anything unlawful.

Acceptable use

Don’t misuse the app. That includes trying to access other people’s data, disrupting the service, scraping it at scale, or using it to break the law.

Third-party content and maps

The app includes information and imagery from third parties, including government agencies, OpenStreetMap contributors, Esri and photo licensors. Each is credited in the app. That content remains subject to its own licence.

The service

The app is currently free and non-commercial. We may change, add or remove features, or stop the service, and we’ll give reasonable notice where we can. Sponsors or paid features may be introduced later, with clear notice and changes to these terms.

Liability

We provide the app “as is”. To the extent the law allows, we aren’t liable for any loss arising from your use of it, including reliance on regulations, conditions or access information.

Nothing in these terms excludes rights you have under consumer law that can’t be excluded, including the Australian Consumer Law, New Zealand’s Consumer Guarantees Act where it applies, and Canadian provincial consumer protection laws.

We may update these terms and will show the date at the top. For significant changes, we’ll tell you in the app. These terms are governed by the laws of [State], Australia.
